Law Encourages Medical Volunteering
Health care professionals who volunteer their time and care to uninsured in need will soon benefit from expanded liability protection. Senate Bill 86, supported by OHA and signed into law last week, extends qualified immunity for health care workers who provide free care to a wide range of health care facilities and locations. The legislation, sponsored by Sen. Steve Stivers (R-Columbus), encourages health care professionals to volunteer their time and services by allowing them to volunteer at hospitals, clinics and other locations at which medical care is provided, reducing the time spent traveling to specified locations.

Effective in April, this law provides that notice be given to indigents who receive free care and it does not provide immunity for civil actions involving “willful or wanton misconduct” or certain medical procedures. The new law also provides limited immunity from civil actions for organizations that refer those in need to doctors and hospitals for proper health care treatment. Seeking Hospital Heroes
Make a hit with one of your hospital’s heroes by making a nomination for OHA’s 2004 Albert E. Dyckes Health Care Worker of the Year Award. OHA is now accepting nominations for the award, which honors caregivers who routinely go beyond the call of duty and give back to the community.

OHA invites every member hospital to nominate one individual to represent your facility for the award. All nominees will be celebrated at the OHA Recognition Dinner June 14, in conjunction with the OHA Annual Meeting June 14-15. The ultimate recipient of the award and four finalists will be named during the dinner, along with recipients of several other OHA awards.

Nomination materials were mailed to hospital public relations and human resources representatives last week and are available online at www.ohanet.org/annualmeeting/Awards/default.htm. Please submit nominations by Feb. 27. All nominations must be made using the official nomination form by e-mail to Tiffany Himmelreich at tiffanyh@ohanet.org.

Quality Initiative Data Ready for Preview
Hospitals that submitted data to the Centers for Medicare & Medicaid Services (CMS) before Dec. 18 as part of the Quality Initiative can now preview their data before it is posted publicly to the CMS Web site mid-February. Hospitals still have until the first week of February to review their quality data, available on the password-protected Web site, www.qnetexchange.org/public/welcome/index.jsp.

There are currently over 2,500 hospitals participating in the Quality Initiative, including nearly 90 Ohio hospitals. Specialty Hospital Issue Under Debate
A teleconference for continuing legal education credit will bring together key experts next week to debate the issue of specialty hospitals and the federal moratorium pertaining to these facilities. The American Bar Association will present “Specialty Hospitals: What’s Behind the Controversy” on Jan. 28 from noon to 1:30 p.m. EST. The event brings together major stakeholders on both sides of the issue, including advocates from the American Surgical Hospital Association and the Coalition of Full-Service Community Hospitals, to offer information on the moratorium passed by Congress as well as positions on both sides of the issue. Panelists include Scott Becker, McGuire Woods Ross & Hardies; Teresa Brooks, Ungaretti & Harris; and James Unland, The Health Capital Group.

House Health Committee Assumes New Chair
Rep. John White (R-Kettering) was named chairman of the House Health and Family Services Committee Tuesday by House Speaker Larry Householder (R-Glenford). White, who previously served as the committee's vice chairman, assumes the post from Rep. Greg Jolivette (R-Hamilton). Rep. Jolivette has resigned his House seat to trade public offices with Courtney Combs and become a Butler County Commissioner. Combs was appointed to the 54th House District seat this week.

OHA advocates met with Rep. White yesterday to recap federal action that temporarily resolved hospitals' concerns over the proliferation of physician-owned hospitals and to advocate against legislative efforts limiting the authority of hospital governing boards in the area of physician credentialing.

Board Approves 2004 HCAP Model
At its last meeting the OHA Board of Trustees recommended a distribution model for the 2004 Hospital Care Assurance Program (HCAP). The recommendation calls for using the structure of the 2002 model for 2004, but limiting the critical access hospitals' pool to allow more equitable distribution to all rural hospitals, and allotting additional funds to pediatric high disproportionate share hospitals. The Ohio Department of Job and Family Services will likely file rules within the next month, which is required before the distribution model can be finalized.

Supporting OHA’s statewide effort to influence public opinion, the Board approved the proposed formula for voluntary assessments on hospitals to fund the initiative. The Board was updated on progress of the campaign, which will be rolled out to hospital CEOs and their designees Jan. 29 during videoconferences around the state.

American Hospital Association (AHA) President Dick Davison addressed the Board with observations on health care in 2003 and outlined the AHA strategic direction plan for 2004. The four-part plan calls for expanding the health care agenda, engaging the nation’s communities in hospital issues, working to solve the multitude of problems facing hospitals and changing America’s mindset to one where health care is an investment, not a cost.

The Board was updated on OHA’s new medical malpractice insurance company, OHA Insurance Solutions, Inc. (OHAIS), which was licensed by the Ohio Department of Insurance Dec. 19 and began issuing policies to physicians around Ohio Jan. 1. OHAIS has received almost $5 million in investments from hospitals and many hospitals are processing investment through their boards and committees.

The Board also heard updates on Ohio’s proposed correct surgery protocol designed to meet Joint Commission on Accreditation of Healthcare Organizations’ requirement that hospitals implement methods to eliminate wrong site surgery by July 1. Hospitals Equipped to Treat Sexual Assault Patients

One of the many ways hospitals serve their communities is by dealing with difficult issues, such as caring for sexual assault victims. To help health care providers on that front, the Ohio Department of Health (ODH), in conjunction with the Ohio Attorney General’s office and several other organizations, developed the Ohio Protocol For Sexual Assault Forensic and Medical Examination.

The protocol was developed to provide comprehensive, equitable treatment of sexual assault victims and assist hospitals with collection of evidence for law enforcement. Materials include information on obtaining and getting partially reimbursed for sexual assault kits, as well as informational handouts for victims and information on the victims’ needs. Cultural sensitivities, child abuse cases and emergency contraception are highlighted, in addition to the importance of Sexual Assault Response Teams, which are present in many hospitals around the state.

ODH sent the most recent version of the protocol to hospital CEOs and directors of emergency nursing in July 2002. CEOs Come Together on New Initiative
OHA will host a video conference next week, bringing together hospital CEOs from around the state to introduce a new and collaborative initiative to increase hospitals' impact in their communities. All CEOs should have received an invitation to the Jan. 29 event, and are encouraged to attend or send a designee to one of 17 designated locations to learn about opportunities this effort holds. OHA Congratulates Associates on New Roles
OHA would like to thank David Haas, vice president of administration & member programs, for his 13 years of service upon his retirement. David retired at the start of this year and transitioned to his new position as treasurer of OHA Insurance Solutions, a newly created medical malpractice insurance company. We wish David success in his continuing work with OHAIS.

OHA also congratulates other associates on expanding roles and responsibilities within the organization. Tim Sisson has been promoted to manager of information systems. Tim is responsible for internal network and technical support, technical assistance on the OHA Web site and other Internet functions. Susan Zabo, who contributes to OHA’s pollution prevention efforts, is now also serving as coordinator of incumbent worker training and education. She will work on OHA workforce efforts related to training eligible hospital associates for positions with specific educational or certification requirements.
